1. Who is responsible for your data
The controller of the personal data collected by this website (fabiancalderon.com) is Fabián Calderón, who operates under the brands Kawsay Comunicación and fabiancalderon.com, based in Quito, Ecuador.

2. What data I collect
I only ask for what is necessary. Depending on how you interact with the site, I may receive:
- Data you give me: name, email, phone or WhatsApp number, company, website and the message you write in the forms (contact and Website review, also called Digital Leaks Diagnosis) or through WhatsApp and email.
- Subscription data: your email and name if you subscribe to my newsletter or download a resource.
- Browsing data: IP address, device and browser type, pages visited, time on the site, where the visit came from and events such as clicks or form submissions. They are collected through cookies and similar technologies (see section 6).
I do not ask for sensitive data (health, ethnic origin, beliefs, biometric data, etc.). Please do not include it in your messages.
3. What I use it for and on what legal basis

I do not make decisions that affect you based solely on automated processing, and I do not sell your data to third parties.
4. Who I share it with
To run the site I use providers that process data on my behalf (data processors). They only receive what is essential for their function:
- Google (Google Tag Manager, Google Analytics 4 and Google Ads): measurement of the site and campaigns.
- MailerLite: subscriber management and email delivery.
- Form delivery service (for example, formsubmit.co) [confirm the one you use]: delivery of form messages to my email.
- Hosting and email provider [name your provider]: hosting of the site and receipt of messages.
- WhatsApp (Meta): if you choose to write to me through that channel, their own terms also apply.

I may also share data with competent authorities when a law or an order from an authority requires it.
5. International transfers
Several of the providers above have servers outside Ecuador (for example, in the United States or the European Union). When your data is transferred abroad, I aim for the provider to offer adequate safeguards under the LOPDP and its Regulation, such as contractual clauses and equivalent security measures. By accepting this policy and the corresponding cookies, you understand that these processing activities may involve international transfers.
6. Cookies and measurement
Cookies are small files that your browser stores to remember information. I use these categories:

The site is set up to respect your choice through Consent Mode v2: if you reject analytics or marketing cookies, the corresponding tags limit the information they send. 7. How long I keep your data
- Inquiries and contacts: while the conversation lasts and up to [24] months afterwards, unless it becomes a commercial relationship.
- Customers: during the contractual relationship and for as long as Ecuador's tax and accounting rules require.
- Subscribers: until you unsubscribe or withdraw your consent.
- Analytics data: according to the retention periods set in my measurement tools [state it, e.g. 14 months in GA4].
When it is no longer needed, I delete it or anonymize it.
8. Your rights
The LOPDP recognizes rights over your personal data. You can exercise them by writing to me at info@fabiancalderon.com:
- Access: know what data of yours I hold and how I use it.
- Rectification and updating: correct inaccurate or outdated data.
- Erasure: ask me to delete your data when applicable.
- Objection: object to certain processing, such as receiving commercial communications.
- Portability: receive your data in a structured, commonly used format, when applicable.
- Suspension of processing: ask me to limit the use of your data in the cases provided by law.
- Not being subject to automated decisions that produce legal effects on you or significantly affect you.
- Withdraw your consent at any time, without affecting what has already been processed.
To handle your request, I may ask you to confirm your identity. I will reply within the deadlines set by current regulations.
You can file a complaint with Ecuador's Superintendence of Personal Data Protection, the supervisory authority on this matter.
9. How I protect your data
I apply reasonable technical and organizational measures to protect your information: encrypted connection (HTTPS), restricted access to data, providers with recognized security standards and spam protection on the forms. No system is 100% infallible; if a breach affecting your data occurs, I will act and inform you as the law requires.
10. Minors
This site and my services are aimed at people over 18 and at companies. I do not knowingly collect data from children or adolescents. If you believe a minor has sent me information, write to me and I will delete it.
11. Changes to this policy and contact
I may update this policy when my services, tools or regulations change. You will always see the date of the last update at the top, and if the change is important, I will let you know in a visible way.
